Bay Area Hijama – Legal Disclaimer
and Wellness Service Agreement

WHEREAS, The Parties to this Agreement share the belief in individuals’ right to choose their healthcare and wellness services, protected under the U.S. Constitution, California Health Freedom Legislation (Senate Bill-577, 2002), and the right to religious beliefs and practices.

Disclaimer:

Non-Liability:

The Clinic and its practitioners expressly state that they are not liable for any claims, damages, or adverse effects arising from the voluntary use of the Hijama therapy services. Clients acknowledge that Hijama is a spiritual practice and that results may vary among individuals.

Nature of Hijama and Health Issues:

Spiritual Practice: Hijama is a spiritual practice deeply rooted in Ancient Egyptian traditions and is highly recommended in Islam. It is a holistic, natural procedure with no guaranteed outcomes. The Clinic emphasizes that it does not practice conventional medicine, diagnose, treat physical or mental diseases, or prescribe medications.

Individual Responsibility:

Clients acknowledge their sole responsibility for their health and well-being. The Clinic does not promise the absence of adverse effects, and clients are advised to seek appropriate medical care in the event of health issues or emergencies.

Release of Liability:

Voluntary Undertaking: Clients acknowledge that the decision to undergo Hijama therapy is voluntary, and they accept any associated risks. The Clinic and its practitioners are released from any liability, claims, demands, actions, or causes of action related to any loss, damage, or injury (including death) that may be sustained during or after the treatment.

No Guarantees:

Clients further acknowledge that the practitioner does not provide any guarantee or warranty as to the success of the therapy, suggestions, protocols, or products. The release of liability is comprehensive and includes any potential legal actions that may arise.

Limitation of Recovery:

Evidence of Wrongdoing: Recovery in any legal action is limited to the client’s actual provable loss, defined as the total dollars expended for services and products. The prevailing party is entitled to reimbursement of arbitration costs. This limitation applies unless there is evidence of negligence or intentional wrongdoing on the part of the practitioner causing mental or physical injury to the client.
By scheduling and undergoing Hijama therapy at Bay Area Hijama, clients affirm that they have read, understood, and agree to the terms outlined in this detailed legal disclaimer and wellness service agreement.
